NASSAU, BAHAMAS – A lawyer has lost his bid to have the Court of Appeal overturn his order for disbarment.

Troy Kellman was ordered struck from the rolls last year in relation to his conduct in a real estate sale, where he acted for the vendor and seller.

In a unanimous decision, the Court of Appeal found that Kellman’s argument that he was denied due process and that the Ethics Committee was not properly constituted when it referred his case to the disciplinary tribunal lacked merit.

Kellman was hired by the Bahamas Mortgage Corporation to prepare a mortgage for Caleb Dorsett and Shamene Bain in 2013.

He gave an opinion that the property was good and marketable but failed to disclose that he also represented Lion Management, the company that was selling the property to Dorsett and Bain.
