Damages Upheld For Unlawfully Arrested Officer

NASSAU, BAHAMAS – The Court of Appeal has upheld an award of damages to a police sergeant who was wrongfully arrested by his superiors, including the current Commissioner of Police. 

Sergeant 2375 Theodore Neilly was arrested on September 1, 2016, after he expressed support for Maria Daxon.

Neilly, who worked at the Criminal Investigation Department, told another police officer that Daxon should be released.

Neilly’s remarks got back to Commissioner Clayton Fernander, who was then head of CID.

Fernander and other officers took Neilly to Police Headquarters in an unmarked police jeep to see former Commissioner Anthony Ferguson.

The Court of Appeal affirmed the decision of Justice Camille Darville-Gomez that Neilly was unlawfully arrested and detained.

The government appealed the decision and lost.

The damages that Neilly will receive has yet to be determined. K Melvin Munroe represented Neilly, who has since retired from the police force.
