NASSAU, BAHAMAS – The Court of Appeal has overturned the acquittal of a man accused of shooting at police in 2020.

The Office of Director of Public Prosecutions challenged the decision of Justice Renae McKay to acquit Jamal Miller of possession of a firearm with intent to endanger life at the close of the prosecution’s case.

In a judgment delivered by Justice of Appeal Bernard Turner, the Court ruled that the trial judge had usurped the function of the jury.

As a result, Miller’s acquittal was quashed and a new trial was ordered before another judge.
