As brainwave-monitoring consumer tech products multiply, Colorado has taken a pioneering step by becoming the first U.S. state to pass a privacy law that protects neural data.

This move could spark a wave of similar legislation, addressing the growing concern over the commodification of brain data.

Colorado’s new law expands the definition of “sensitive data” under its consumer protection act to include neural and other biological data, setting a precedent for protecting individuals’ mental privacy as technology continues to evolve.
