NASSAU, BAHAMAS – A woman jailed for luring a witness against a notorious gang member to his death has lost an appeal against her conviction.

However, Caryn Moss won an appeal against her 35-year sentence, with the Privy Council directing the Court of Appeal to resentence her.

Moss was convicted of conspiracy to murder O’Neil Marshall, who was also known as Yardy.
Marshall was placed in the witness protection program after he agreed to testify in the upcoming abetment to murder case of a gang member.

He was murdered between April 30, 2016 and May 1, 2016. His bullet-riddled and partially burned body was found in a car in the parking lot of the former City Market Food Store on Market Street.

Moss admitted that she picked up Marshall and parked the car through Yorkshire Street.

She left Moss in the car, which had the child safety locks deployed, and the handles removed, before she went to her godfather’s house under the pretext that she wanted to use the phone.

While in the home, Moss said she heard about seven or eight gunshots.

The Privy Council upheld Moss’ conviction, saying that the defense of duress was not available to her.

However, the country’s apex court said that the Court of Appeal should have considered whether Moss acted under coercion in sentencing her.
