NASSAU, BAHAMAS – A judge has dismissed a murder suspect’s claim that an amendment to the Bail Act is unconstitutional.

Emmanjane Fitzgerald’s bail was revoked after she was convicted of breaching her bail conditions for the 2015 murder of her reported boyfriend Keith “Fad Head” Russell in Grand Bahama.

She was granted $20,000 bail in 2016.

After the Court ordered the removal of her ankle bracelet, Fitzgerald traveled to Colombia in 2019 without court approval.

Colombian police arrested Fitzgerald on drug possession charges.

She was deported to The Bahamas in 2024 and charged with breach of bail.

She pleaded guilty and was ordered to pay a fine of $4,000 to avoid spending eight months in prison.

Fitzgerald served the sentence, as a judge also revoked her bail.

In a constitutional motion filed in April 2025, Fitzgerald alleged that her arrest, trial and detention pursuant to the Bail amendment were unconstitutional and void.

She asked Justice Andrew Forbes to give her bail and to award damages.
