NASSAU, BAHAMAS – A court has dismissed a negligence claim against Fourth Terrace Diagnostic Services after finding the action was statute-barred.

Dion Davis filed a lawsuit against the medical service provider after he allegedly suffered a permanent deformity to his right hand as a result of an alleged misdiagnosis in 2020.

On May 11, 2020, Davis went to Fourth Terrace Diagnostic for an x-ray after he injured his hand.

A subequent report said that no fracture or dislocation had occurred, and due to this finding his doctor took no further action.

However, days later, Davis’ hand began to swell and returned to Fourth Terrace Diagnostic.

The initial report was amended on May 20, 2020, and a recommendation was made for orthopedic referral.

But due to the delay in the diagnosis, the time-frame to reset Davis’ finger had passed, resulting in a permanent disability.

Assistant Registrar Akeira Martin struck out the claim after finding that Davis had waited too long to file his claim.

She said the deadline do so was May 20, 2023.
