NASSAU, BAHAMAS – A convicted armed robber has won the chance to launch a constitutional challenge to the conditions at the prison.

Marco Oliver was sentenced to 10 years and eight months following his conviction in 2016.

Oliver claims that his rights are being violated by only getting 15 minutes of exercise instead of one hour as stipulated in the Correctional Services Inmates Rules.

Justice Deborah Fraser dismissed a previous constitutional application in 2022 after ruling that Oliver had not exhausted all avenues by addressing his grievances to the Correctional Services Review Board.

The Court of Appeal quashed the judge’s decision and has ordered a new judge to hear Oliver’s constitutional challenge.
