Judge Rejects Met Officer’s Claim That Work Conditions Damaged His Health

NASSAU, BAHAMAS – The Supreme Court has dismissed well-known met officer Wayne Neely’s claim of negligence against the government after he was diagnosed with mold hypersensitivity syndrome.

In his lawsuit against the Attorney General, Ministry of Transport and Aviation, and Public Service, Neely alleged that his declining health was caused by subpar working conditions and mold exposure in a condemned building.

Following his diagnosis, Neely alleged that his symptoms recurred whenever he returned to work. He said he experienced hardship after his pay was cut while on extended sick leave.

Supreme Court Justice Camille Darville-Gomez rejected the claim, saying there was no reliable evidence that Neely’s illness was caused by his workplace conditions.

The defendants contended that Neely’s complaints were addressed in a timely manner by repairing the roof, carrying out mold remediation and an overhaul of the air-conditioning system.

Further, repeated air-conditioning quality tests did not show elevated mold spores levels. They noted that Neely was the only employee affected, suggesting that the exposure happened in another place.
