NASSAU, BAHAMAS – A Bahamian real estate agent has lost her appeal in a multimillion-dollar commission dispute involving the sale of a luxury property in Lyford Cay.

The Court of Appeal ruled against Diane Holowesko, who was seeking more than $2.3 million plus VAT in commission following the $58 million sale of Harbour House.

Holowesko argued that she was entitled to a 4% commission after introducing businessman Fabio Mantegazza to the property and arranging a viewing.

However, the court found that her commission agreement depended on securing a $57 million deal by April 8th, 2022.

That deadline was not met, and the property was later purchased for $58 million through the seller’s agent.

In a judgment delivered on October 28th, the Court of Appeal upheld the lower court’s decision, dismissing Holowesko’s appeal.

She was also ordered to pay legal costs.
