Acquitted Attorney Suing Police Chief and AG Over 2024 Arrest

NASSAU, BAHAMAS – An attorney, previously prosecuted for disorderly conduct and obscene language after being denied access to his client, is now alleging malicious prosecution, unlawful detention, and abuse of process.

NASSAU, BAHAMAS – A defense attorney who was arrested and prosecuted for disorderly conduct and obscene language after police officers refused him access to his client is now suing the Commissioner of Police and Attorney General, alleging malicious prosecution, unlawful detention, and abuse of process.

Attorney David Cash is seeking to recover the almost $12,000 that he spent on lawyer fees and compensation for the damage to his reputation.

The lawsuit stems from Cash’s arrest at the Central Police Station in Freeport, Grand Bahama on November 2, 2024.

Cash, who is based in New Providence, traveled to Freeport to see his client, Mervie Knowles, the owner of the elder care facility Home Away From Home.on November 2, 2024, at the Central Police Station in Freeport, Grand Bahama.

Cash, who is based in New Providence, traveled to Freeport to see his client, Mervie Knowles, the owner of the elder care facility Home Away From Home, who had been accused of fraudulently taking possession of the assets of Ingrid Carey, who was in her care.

A police sergeant on duty refused to let Cash see Knowles, claiming that she had another lawyer.

He was arrested and detained for 11 hours after describing the officer’s actions as a “bunch of [expletive deleted].”

Cash was acquitted in July.

Before Magistrate Laquay Laing threw out the case, the Attorney General’s Office had offered to drop the case on the condition that he apologize to the police officer and sign a deed of release, preventing him from suing.
