One Court Ruling: Two Different Points Of View

THE BAHAMAS – It is a classic Bahamian conflict: the push for high-end economic development versus the protection of the pristine environment.

On Friday justice Leif Farquharson delivered a nuanced ruling in the judicial review, brought against the developer, Yntegra, by Turtlegrass Resort and Over Yonder Cay.

The headlines from both sides tell two different stories.

Turtlegrass advocates are celebrating an injunction prohibiting dredging and other works, pending the determination of the judicial review.

The court has specifically restrained works proposed in the North Bay of Sampson Cay, which includes land clearing, excavation, and infrastructure installation.

However, Yntegra is framing the day as a “Positive step forward”.

They point out that the judge dismissed an application by over Yonder Cay, to restrain all works, reinforcing that the project may move forward in other areas.

Crucially, the court is allowing preparatory work, such as geo-technical investigations and studies, to continue.

Yntegra also notes that no dredging was underway as applications remain under review by government agencies.

The heart of the legal battle sits on two main pillars:
Procedural integrity: Turtlegrass alleges the environmental approval process was procedurally flawed, citing inadequate consultation and lack of timely disclosure of key materials.

And, the price of a pause: Justice Farquharson ordered Turtlegrass to provide $3 million within 14 days as financial security to support the limited injunction.

While significant, this is a fraction of the $30 million bond Yntegra had requested, which the court found largely speculative.

Justice farquharson remarked that while the challengers established a “serious question to be tried,” he does not currently view the applicant’s case as “particularly strong”.

For now, the heavy machinery remains silent in North Bay, but the legal proceedings are just getting started.

Yntegra maintains they are committed to full environmental compliance and responsible phased development.
