NASSAU, BAHAMAS – The Court of Appeal affirmed the one-year sentence for a man who breached his murder bail curfew six times on Wednesday.

The Court described Riclaude Tassy’s breaches as egregious.

Between July 4, 2022 and August 21, 2022 Tassy ignored his daily curfew on six separate occasions—and on August 21 he allowed the device to go dead.

Tassy, who was represented by counsel, admitted the bail violations last September and was sentenced to one year in prison.

However, Tassy appealed the sentence, arguing that it was unduly harsh.

But, the court disagreed, saying the curfew breaches reflected a complete disregard for the conditions imposed. On the other hand, the Court said a one-year jail term was too severe for letting the device go dead.

As such, the court imposed a $5,500 fine or two months in prison for that offense.

The court warned that if persons violate their bail conditions they risk jail time, and this could be the basis for revoking their bail.

Additionally, the court said if the a bail violator is subsequently convicted of the offense for which bail was granted, the time spent in custody for the bail violation would not be deducted from the sentence imposed.

A conviction for violating bail attracts a sentence of up to two years in prison and a maximum fine of $50,000.
