FLORIDA- A Bahamian green card holder accused of illegally voting in the 2024 presidential election is challenging the constitutionality of the federal law used to prosecute him.

38-year-old Terrance Patrick Evans, who is a lawful permanent resident, is charged with voting in a federal election despite not being a U.S. citizen.

In a motion to dismiss, his attorneys argue congress exceeded its constitutional authority by prohibiting noncitizens from voting, claiming the power to determine voter eligibility belongs to individual states.

The defense points to a recent South Florida Federal Court ruling dismissing a similar charge on constitutional grounds.

While a green card allows someone to legally live and work in the United States, it does not grant voting rights.

Evans is asking a federal judge to dismiss the charge.
