NASSAU, BAHAMAS – The supreme court has overturned an $866,000 default judgment against Sun Oil and FOCOL, in a lawsuit tied to the alleged theft of more than 41,000 gallons of fuel in 2017.

Former employee Jonathan Pratt sued for wrongful dismissal and reputational damage.

Acting Assistant Registrar Adrienne Bellot ruled that damages needed court assessment.

She accepted the companies’ explanation for missing the filing deadline that triggered the default judgment and found they had a realistic chance of defending the claim.

The companies must pay Pratt $10,000 in costs.

They have seven days to seek dismissal of his claim, or 14 days to file a defense if they drop that bid.
